Handhaving natuur- en milieuwetgeving Caribisch Nederland onder de maat

(Kralendijk, Bonaire) – De handhaving van natuur- en milieuwetgeving moet volgens de Raad voor de rechtshandhaving veel beter. Uit onderzoek van de Raad is gebleken dat er in Caribisch Nederland (Bonaire, Sint Eustatius en Saba) weinig aan toezicht en handhaving wordt gedaan.

Organisaties kijken naar elkaar en werken weinig samen, en medewerkers van de openbare lichamen met opsporingsbevoegdheid maken geen gebruik van hun mogelijkheden om een bijdrage te leveren aan de handhaving. Als voorbeeld noemt de Raad de geitenproblematiek. Op alle drie de eilanden is het verboden geiten los te laten lopen, maar op geen van de eilanden wordt dat verbod gehandhaafd. De gevolgen voor de vegetatie op het land en voor de koralen in zee zijn desastreus.

Ook ontbreekt het aan wettelijke voorgeschreven beleidsplannen, een verantwoordelijkheid

Van zowel de openbare lichamen als de Rijksoverheid.

De politie, het openbaar ministerie, de lokale natuurbeschermingsorganisaties en de openbare lichamen zullen onderling goed moeten afspreken wie waarvoor verantwoordelijk is. Dat er extra inspanningen nodig zijn, staat volgens de Raad buiten kijf. De Raad noemt in zijn rapport een aantal noodzakelijke stappen om toezicht en handhaving op het terrein van natuur- en milieuwetgeving op peil te brengen, en doet in zijn rapport daarvoor een aantal concrete aanbevelingen aan de betrokken organisaties.

In het onderzoek lag de focus op een van de belangrijkste oorzaken voor de bedreiging van de natuur op en rond de eilanden, namelijk loslopend vee. Ook heeft de Raad nadrukkelijk gekeken naar handhaving van het verbod vuil te storten. De natuurlijke schoonheid van de eilanden vormt immers het visitekaartje voor de toeristen van wie de eilanden voor een (groot) deel afhankelijk zijn.

Uit het onderzoek is onder meer gebleken dat er wel wordt gewerkt aan plannen om het geitenprobleem aan te pakken, maar dat daar nauwelijks tot geen vervolg op komt. Wat betreft de bestrijding van zwerfvuil heeft de Raad grote verschillen geconstateerd tussen de drie eilanden. Op Saba wordt direct opgetreden als er sprake is van illegaal gedumpt afval. Saba maakt dan ook een bijzonder schone indruk. Het openbaar lichaam Sint Eustatius slaagt er steeds beter in illegale afvaldumpingen aan te pakken. Aan de andere kant is Bonaire er de laatste jaren bepaald niet schoner op geworden, en handhaving van het verbod afval te dumpen vindt nauwelijks plaats.
