Rapporteren over huiselijk geweld Caribisch Nederland blijft uit

(Kralendijk, Bonaire) – De Raad voor de rechtshandhaving stelt vast dat politie en openbaar ministerie in Caribisch Nederland in verschillende opzichten nog niet conform de aanwijzing werken die de Procureur-Generaal van het Openbaar Ministerie van Curaçao, van Sint Maarten en van Bonaire, Sint Eustatius en Saba in 2017 gaf over relationeel geweld. Het ontbreekt aan onder meer aan het periodiek rapporteren aan de Procureur-Generaal. Doel van deze aanwijzing is het verbeteren van de aanpak van huiselijk geweld door het openbaar ministerie en de politie.

De Raad voor de rechtshandhaving heeft in het vierde kwartaal van 2019 onderzoek gedaan naar de aanpak van huiselijk geweld in Caribisch Nederland (Bonaire, Sint Eustatius en Saba). Daarbij heeft de Raad in eerste instantie gekeken naar de justitiële aanpak.

Waar het gaat om repressief optreden tegen huiselijk geweld zijn het openbaar ministerie en de politie aan zet. Een probleem is dat slachtoffers van huiselijk geweld soms geen aangifte bij de politie willen doen uit angst voor de gevolgen. De Raad vindt dat de politie in die gevallen altijd met het openbaar ministerie moet overleggen over gewenste vervolgstappen. Waarbij voorop moet staan dat huiselijk geweld niet wordt geaccepteerd.

In Caribisch Nederland is in 2017 een veelbelovende start gemaakt met de aanpak van huiselijk geweld waarover het ministerie van Volksgezondheid, Welzijn en Sport (VWS) en de openbare lichamen Bonaire, Sint Eustatius en Saba in dat jaar een bestuursakkoord hebben gesloten. Dit leidde tot het vergroten van de kennis en van het inzicht bij professionals van wat huiselijk geweld is, als ook door het bespreekbaar maken van huiselijk geweld in de samenleving.

De repressieve aanpak kan niet los worden gezien van de preventieve aanpak. Bij de preventie van huiselijk geweld zijn bewustwording en voorlichting belangrijke aspecten. De justitiële partijen leveren daar nuttige bijdragen aan. De samenwerking en informatie-uitwisseling tussen de betrokken organisaties van zowel de justitiële als de zorgketen zijn van essentieel belang en kunnen beter, aldus de Raad.

De Raad benadrukt dat voor structurele bestrijding van huiselijk geweld een lange adem nodig is. Alles wat in het kader van het bestuursakkoord in gang is gezet, zal moeten worden voortgezet na de afloop van dat akkoord in 2020.

De Raad doet verschillende aanbevelingen aan de minister van Justitie en Veiligheid (JenV). Deze betreffen onder andere wetgeving, overleg tussen de politie en het openbaar ministerie, en informatie-uitwisseling met de ketenpartners.

De minister van JenV heeft het rapport van de Raad onlangs aangeboden aan de Tweede Kamer en daarbij laten weten dat zowel de betrokken ministeries als alle betrokken organisaties de aanbevelingen van de Raad omarmen. Volgens de minister is het nu zaak om door te zetten en om de aanbevelingen voortvarend op te pakken.

De Raad heeft zijn rapport met aanbevelingen kort voor het uitbreken van de corona-crisis aangeboden aan de minister van JenV. De maatregelen die in het kader van die crisis zijn genomen, zoals de sluiting van scholen en het zoveel mogelijk binnen blijven, vormen extra risico’s voor huiselijk geweld. Daarom is het volgens de Raad nu van nog groter belang dan voorheen dat de maatschappij goed geïnformeerd blijft over de risico’s, het bewustzijn en signaleren van huiselijk geweld alsmede de mogelijkheden van het melden van vermoedens daarvan.
