Willemstad, 27 mei 2015 – Recentelijk heeft de Raad voor de Rechtshandhaving (Raad) op basis van een inspectieonderzoek een rapport met constateringen en aanbevelingen uitgebracht omtrent de beveiliging van gezagdragers. De aanleiding voor dit inspectieonderzoek was de moord op het voormalig lid van de Staten, wijlen de heer Wiels op 5 mei 2014. De probleemstelling luidde als volgt: In hoeverre is de beveiliging van gezagsdragers in Curaçao in wet- en regelgeving en in beleid geregeld en hoe wordt de beveiliging van gezagsdragers in de praktijk uitgevoerd? De Raad achtte het opportuun om verschillende aanbevelingen aan de Minister van Justitie aan te bieden om de beveiliging van gezagsdragers op adequate wijze te regelen.
Tragisch incident van 5 mei 2014 als aanleiding voor het inspectieonderzoek
De laatste jaren was het normaal dat gezagsdragers op Curaçao zich door beveiligers lieten begeleiden wanneer zij zich in het openbaar vertoonden. Op 5 mei 2013 heeft de heer Wiels zijn beveiligers vrijaf gegeven en bewoog hij zich zonder beveiliging door de straten van Curaçao. Op deze dag werd de heer Wiels op het strand van Mari Pampun vermoord.
Deze moord heeft voor een grote schok binnen de gemeenschap op Curaçao gezorgd en vormde voor de Raad voor de Rechtshandhaving de aanleiding om een inspectieonderzoek naar de beveiliging van gezagsdragers op Curaçao in haar jaarplan 2014 op te nemen. Dit inspectieonderzoek hield in een onderzoek naar de wijze waarop de beveiliging van gezagsdragers op Curaçao werd uitgevoerd. Hierbij werden in beschouwing genomen: de wet- en regelgeving, het gevoerde beleid en de wijze waarop dit beleid in de praktijk uitgevoerd werd.
Bevindingen
Dit inspectieonderzoek wijst uit dat de organisaties die bij de beveiliging van gezagsdragers betrokken zijn in de wet- en regelgeving zijn aangewezen, maar tegelijkertijd blijkt dat de daadwerkelijke uitvoering van de beveiliging niet op voldoende wijze in de wet- en regelgeving is opgenomen.
Uit het inspectieonderzoek blijkt tevens dat deze organisaties niet over een vastgesteld beveiligingsbeleid ten aanzien van de beveiliging van gezagsdragers beschikken. Van eenduidige procedures was ook geen sprake.
Voor wat betreft de praktijkuitvoering blijkt dat er een tekort aan gekwalificeerd beveiligingspersoneel bestaat. Ook blijkt dat de organisaties niet over voldoende financiële en materiële middelen beschikken om de beveiliging van gezagsdragers uit te voeren.
Een andere bevinding van de Raad is dat door politieke verwikkelingen in verschillende gevallen geen vertrouwen bestond tussen de door de betrokken organisaties aangewezen beveiligers en bepaalde gezagsdragers en wezen de gezagsdragers zelf hun beveiligers binnen deze organisaties aan. Deze werkwijze drukt zwaar op de begrotingen (veel overuren), het personeel (lange dagen) en het materieel (meer slijtage en tekort).
Ook constateert de Raad dat tussen de verschillende organisaties die in de verschillende fasen bij de beveiliging van gezagsdragers betrokken zijn, geen structurele samenwerkingsverbanden en overlegmomenten vastgesteld zijn.
