WILLEMSTAD – Sentro di Detenshon i Korekshon Kòrsou (SDKK) voert een aantal processen uit om de bejegening van gedetineerden te optimaliseren. Ook worden diverse trajecten gevolgd om de rechtspositie van de gedetineerden naar internationale normen op te krikken. Het SDKK voldoet echter nog niet volledig aan alle internationale normen.
Tot deze conclusie komt de Raad voor de Rechtshandhaving (Raad) na een inspectieonderzoek. De Raad nam ook de aanbevelingen van het Europese ‘Committee for the Prevention of Torture’ (CPT) mee, om na te gaan in hoeverre het SDKK aan (internationale) wet- en regelgeving voldoet. De Raad doet negentien aanbevelingen om de gedetineerdenzorg en ook de personele en organisatorische voorzieningen te verbeteren.
Meer medici
De minister van Justitie moet voor voldoende artsen in het SDKK zorgen, stelt de Raad. Er zouden er minstens twee moeten zijn, maar er is maar één arts verbonden aan de instelling. Mogelijk is de animo bij lokale medici laag om voor het SDKK te werken. “Werf ze dan eventueel in het buitenland (de regio)”, stelt de Raad voor.
Ook ziet de Raad graag dat de medische zorg beter wordt zodat tenminste ook preventieve zorg kan worden aangeboden evenals een medische controle binnen 24 uur na aankomst van een gedetineerde. Verder in de gezondheidssfeer wil de Raad op korte termijn verdere vorderingen zien op hygiënisch gebied. Daarvoor moeten toepasselijke afspraken worden vastgelegd en uitgevoerd. En: “Hanteer een proces om continu de kwaliteit en variëteit van het voedsel te evalueren.”
Ventilatie en informatie
Op middellange termijn doet het SDKK er goed aan om de ventilatie van cellen te verbeteren en de verbouwingen, die aan de gang zijn, voort te zetten. Er moet ook een activiteitenprogramma worden opgesteld, evenals het aanwijzen van vertrouwenspersonen.
Dat niet alle huisblokken een brievenbus hebben, keurt de Raad niet goed omdat zo, onder andere, het recht op privacy niet wordt gewaarborgd. De mogelijkheden om de media te kunnen volgen moeten snel worden verbeterd. Brochures over de rechten en plichten van de gedetineerden moeten ook zo spoedig mogelijk worden uitgereikt. Een soepele levering van vonnissen door het Openbaar Ministerie en het registreren daarvan moet ook snel tot stand komen: niet alle dossiers bevatten namelijk een vonnis.
Sancties en klachten
Bij het beoordelen of een gedetineerde in aanmerking komt voor Electronisch Toezicht of voor Voorwaardelijke Invrijheidsstelling, ziet de Raad graag dat rekening wordt gehouden met het gedrag van de betrokkene over de gehele detentieperiode. De regeling voor sancties en de registratie daarvan moeten worden aangepast en verbeterd.
Het klachtenproces moet worden afgerond en de mogelijkheid moet worden geëvalueerd dat een klacht-indiener een ontvangstbewijs krijgt.
Integriteit en capaciteit
Het SDKK moet van de Raad op korte termijn ervoor zorgen dat de integriteitsregels voldoende bekend raken bij het personeel. Er is een gedragscode binnen de justitiële keten en het SDKK heeft instructies voor zijn personeel. Het beveiligingspersoneel van het SDKK en een aantal afdelingshoofden hebben een cursus integriteit gevolgd bij het Opleidingsinstituut Rechtshandhaving en Veiligheid.
Maar meer personeel is ook nodig. Dat zal ook voor het opvolgen van andere aanbevelingen helpen: er kunnen momenteel, bijvoorbeeld, geen activiteitenprogramma’ s op structurele wijze worden uitgevoerd omdat het personeel, dat onvoldoende voorhanden is, ingezet moet worden om de veiligheid van rivaliserende bendes te borgen.
