Review-onderzoek vervolgingsbeleid van het Openbaar Ministerie

Willemstad – De Raad beoogt met dit onderzoek de mate waarin de aanbevelingen van het inspectierapport “het vervolgingsbeleid van het Openbaar Ministerie” zijn opgevolgd vast te stellen.

Ter beantwoording van deze onderzoeksvraag zijn de volgende deelvragen geformuleerd:
1. Wat is de stand van zaken?
2. Welke acties zijn ondernomen ter uitvoering van de aanbevelingen?
3. Welke knelpunten doen zich voor bij de implementatie van de aanbevelingen?
4. Hoe worden deze knelpunten aangepakt?
5. Wat is het resultaat?

Volgens artikel 207, eerste lid, van het Wetboek van Strafvordering dient het Openbaar Ministerie, indien het naar aanleiding van het ingestelde opsporingsonderzoek van oordeel is dat vervolging moet plaatsvinden, zo spoedig mogelijk daartoe over te gaan. Voorts bepaalt het Wetboek van Strafvordering in artikel 207, tweede lid, dat van vervolging kan worden afgezien op gronden aan het algemeen belang ontleend.
Het Openbaar Ministerie moet de vraag of strafrechtelijke interventie het aangewezen middel is in beschouwing nemen. De huidige opvatting is bijvoorbeeld dat illegale bouw beter bestuursrechtelijk zou kunnen worden aangepakt, tenzij er sprake is van bijvoorbeeld witwassen. In dit verband is er ook een richtlijn uitgebracht voor de afhandeling van fiscale- en douanezaken.
Zoals het Hof meerdere malen heeft bepaald is in artikel 207, eerste lid, van het Wetboek van Strafvordering uitsluitend aan de officier van justitie de bevoegdheid toegekend om zelfstandig te beslissen of naar aanleiding van een ingesteld opsporingsonderzoek tot vervolging dient te worden overgegaan.
De ruime vervolgingsbevoegdheid van de functionarissen van het Openbaar Ministerie is geen vrijbrief voor willekeur. Voorts zou het Openbaar Ministerie de strafwaardigheid van een feit in beschouwing moeten nemen. Bijvoorbeeld in gevallen dat er sprake is van een bestendige praktijk (common practice) zou dat aanleiding kunnen vormen om minder ingrijpende sancties toe te passen. Dit sluit ook aan bij de ultimum remedium gedachte.
Volgens jurisprudentie kan de duur van het proces vanaf de dies a quo tot het eindvonnis per instantie twee jaar in beslag nemen.

In 2015 constateerde de Raad dat geen gebruik werd gemaakt van de aan de Minister toekomende bevoegdheid tot het geven van algemene aanwijzingen. Voorts heeft de Raad de minister aanbevolen om te bevorderen dat zaken binnen een redelijke termijn worden afgehandeld.
De Raad constateert dat de algemene aanbevelingen niet zijn opgevolgd. De Raad is van oordeel dat de Minister moet zorgdragen voor de nodige beleidsondersteuning om het vervolgingsbeleid te kunnen vaststellen. De Raad is van oordeel dat de Minister in dit verband onder meer door strafrechtsdeskundigen kan worden bijgestaan.
Voor wat betreft de aanbevelingen ten aanzien van het Openbaar Ministerie, oordeelt de Raad als volgt. De Raad juicht het initiatief van het Openbaar Ministerie toe om richtlijnen uit te vaardigen. Dit komt de transparantie en de rechtszekerheid ten goede. De Raad is van mening dat dit proces moet worden voortgezet, zodat andere belangrijke richtlijnen kunnen worden vastgesteld. Tot deze richtlijnen behoren in ieder geval de richtlijnen inzake sepotgronden. In het verleden werden bepaalde aangiftes door een commissie getoetst, alvorens een uitgebreid strafrechtelijk onderzoek op te starten c.q. voort te zetten. De Raad acht het wenselijk om deze mogelijkheid ook in de toekomst te benutten.
De Raad is tevens van oordeel dat in het kader van een integrale aanpak, samenwerkingsafspraken moeten worden gemaakt over de wijze van interventie. Hiermee is reeds een aanvang gemaakt door het publiceren van de richtlijn met betrekking tot de douane- en fiscaalrechtelijke misdrijven. De Raad is van oordeel dat dit traject moet worden voortgezet en uitgebreid tot andere beleidsterreinen.
De Raad is van oordeel dat het Openbaar Ministerie onvoldoende verantwoording aflegt voor wat betreft de afdoening van zaken binnen een redelijke termijn. De Raad is van oordeel dat het Openbaar Ministerie bijvoorbeeld op basis van de jaarverslagen specifiek, bijvoorbeeld door middel van statistiek, zou kunnen aangeven of de afhandeling van zaken binnen een redelijke termijn al dan niet is verbeterd.
De Raad juicht toe dat het Openbaar Ministerie een efficiency traject heeft opgestart en is van oordeel dat de administratieve ondersteuning periodiek moet worden geëvalueerd. De Raad is van mening dat dit een continu-proces betreft en dat het Openbaar Ministerie hierin moet blijven investeren. De Raad verwacht dat na dit efficiency traject de doorlooptijd van zaken inzichtelijk kunnen worden gemaakt.
De Raad concludeert dat de algemene aanbevelingen niet zijn opgevolgd en dat de aanbevelingen die aan het Openbaar Ministerie waren gericht, behoudens de afhandeling van zaken binnen een redelijke termijn, naar tevredenheid zijn opgevolgd.
De volgende aanbevelingen vloeien voort uit het review-onderzoek vervolgingsbeleid Openbaar Ministerie:
– Leg verantwoording af voor de (tijdige) afhandeling van zaken door middel van o.a. jaarverslagen;
– Maak in verband met de integrale aanpak samenwerkingsafspraken met andere handhavingsinstanties omtrent de wijze van interventie;
– Maak stelselmatig gebruik van de toetsingscommissie om de beperkte capaciteit zo optimaal mogelijk in te zetten.
