Noodzakelijke verbeteringen bij SDKK

WILLEMSTAD – Onvolledige screening bij binnenkomst, het niet uitvoeren van urine controle ter vaststelling van mogelijke gevallen van drugsgebruik na relatiebezoek en het ontbreken van detentieplannen ten behoeve van de maatschappelijke re-integratie zijn enkele van de aandachtspunten die de Raad voor de Rechtshandhaving (Raad) signaleert tijdens de inspectie.

De Raad onderkent dat het SDKK structureel aan verbeteringen werkt. Hiervoor is de basis gelegd met het opstellen van het plan van aanpak om de aanbevelingen van de Raad op te volgen, zoals geformuleerd in het rapport ‘Veiligheidssituatie in de Sentro di Detenshon i Korekshon Kòrsou 2015’.

Beheersing calamiteit
Er is een concept ontruimings- en een calamiteitenplan die op formalisering wachten. Derhalve zijn er geen jaarlijkse evaluatie en zo nodig aanpassingen van plannen op het gebied van beveiliging, integriteit, Bedrijfshulpverlening (BHV), calamiteiten of ontruiming.

Screening
Niet alle afdelingen van het SDKK voeren een volledige screening uit teneinde de risico’s en de behoeftes van de gedetineerden vast te stellen. Wat wel gebeurt, is dat bij constatering dat gedetineerden veiligheidsrisico lopen op grond van hun geloof of seksuele oriëntatie of wegens veroordeling vanwege verkrachting of misbruik van kinderen, zij meestal in Blok 1 of op de Forensische Observatie Behandeling en Begeleiding (FOBA) worden opgesloten. De Raad ziet graag dat de huisblokken in overleg met de gedetineerde de bijzondere omstandigheden, waarmee tijdens de detentie rekening moeten worden gehouden, vaststellen.

Positief is dat het SDKK voornemens is om, na het operationaliseren van een Aankomstenafdeling, een uitgebreide screening te introduceren. Deze zal worden uitgevoerd door een multidisciplinair team. De gedetineerden bestemd voor alle huisblokken – inclusief de vrouwenafdeling – zullen dan worden gescreend, wat nu niet het geval is.

Urinecontroles
Wat ook op korte termijn moet gaan plaatsvinden zijn urinecontroles en controle aan het lichaam na relatiebezoek.

PIW
Er zijn geen gedragscodes en huisregels voor de bejegening van de gedetineerden. De module bejegening is onderdeel van de opleiding voor de Penitentiair Inrichtingswerker (PIW). Het merendeel van het personeel is opgeleid tot PIW-er.

Alhoewel het merendeel van het personeel PIW-er is worden geen mentoren aan de gedetineerden toegewezen. Het komt ook voor dat er geen rapportages worden opgesteld over het detentietraject van de gedetineerde.

De Raad doet de aanbeveling om de PIW-ers op middellange termijn de nodige PIW-taken te laten uitvoeren op alle afdelingen.

Re-integratie
Uit veiligheidsoverweging is het vrijwel onmogelijk om activiteiten, bijvoorbeeld op het gebied van onderwijs of van arbeid, buiten de inrichting te organiseren. Tevens worden intramurale re-integratietrajecten door veiligheidsrisico’s belemmerd. De Raad beveelt het SDKK aan om na te gaan wat voor alternatieve oplossingen haalbaar zijn om extramurale re-integratietrajecten uit te voeren.

Agressiebeheersing
Het geüniformeerde deel van het personeel (bewaarders en beveiligers) is opgeleid in de toepassing van de geweldinstructie van het SDKK. Ook is er een Bureau Klachten Toezicht & Controle, dat geweld tussen de gedetineerden onderling onderzoekt. Verder is er een Intern Bijstand Team (IBT) dat ingezet wordt bij incidenten van agressie. Tenslotte is er ook een Bureau Interne Relaties (BIR) dat onderzoek doet als een personeelslid geweld heeft aangewend tegen een gedetineerde.

Ten behoeve van geweldsbeheersing beveelt de Raad aan om jaarlijks trainingen in fysieke vaardigheden en het gebruik van geweld(middelen) te verzorgen. De bedoeling is om al het personeel – inclusief het burgerpersoneel – dergelijke trainingen te laten volgen.
