Eindrapport Inspectieonderzoek Uitwisseling van politie- en justitiële gegevens binnen het Koninkrijk

Willemstad, 9 juni 2016 – In 2015 werd door de Raad voor de Rechtshandhaving onderzoek verricht naar de uitwisseling van politie- en justitiële gegevens binnen het Koninkrijk. Het rapport van dit onderzoek is inmiddels gereed en aangeboden aan de Minister van Justitie. In de Rijkswet is bepaald dat de Raad zijn rapport zes weken nadat het aan de minister is aangeboden, openbaar kan maken. Deze termijn is verstreken en bijgevolg is het rapport overeenkomstig de vigerende regeling gepubliceerd. In het rapport worden de bevindingen van de raad gepresenteerd met betrekking tot opsporing binnen het Koninkrijk.

De raad heeft vastgesteld dat het uitwisselen van informatie tussen de korpsen een grote mate van vrijblijvendheid kent. Een en ander ondanks het feit dat de Rijkswet een verplichting oplegt aan de betrokken politiekorpsen om gegevens uit te wisselen indien dat noodzakelijk wordt geacht. Ten tweede ontbreekt een wettelijke grondslag voor de onderlinge regeling tussen Curaçao, Sint Maarten en Nederland met betrekking tot het verwerken van politiegegevens in Curaçao. Tevens bevat het huidige Wetboek van Strafvordering beperkte voorschriften en bepalingen voor het verwerken en verstrekken van politiegegevens. De Raad adviseert daarom om het Wetboek van Strafvordering aan te vullen met een bepaling die informatie-uitwisseling tussen politie onderling mogelijk maakt zonder tussenkomst van het OM.
Het uitwisselen van gegevens geschiedt in de praktijk door middel van rechtshulpverzoeken via het OM of politiële verzoeken. Het traject en de daarbij geldende afspraken en uitgangspunten is bij alle instanties bekend. Een duidelijke richtlijn over de wijze waarop gegevens in de vorm van rechtshulpverzoeken worden uitgewisseld, zoals dat het geval is in Nederland, ontbreekt echter bij het OM te Curaçao. Het uitwisselen van gegevens in geval van politiële verzoeken verloopt in de praktijk zowel via de liaison officer als direct tussen opsporingsambtenaren bij de verschillende korpsen. Opvallend daarbij is dat de Landsrecherche als enige opsporingsdienst op Curaçao geen gegevens met andere opsporingsdiensten binnen het Koninkrijk uitwisselt en verwerkt.
Op grond van het onderzoek komt de Raad tot een aantal conclusies en aanbevelingen op het gebied van gegevensuitwisseling, -verwerking, -gebruik en -administratie volgens internationale normen, toetsing op rechtmatigheid, bewaartermijnen, geheimhouding, autorisatie en technische en organisatorische beveiliging.
Met de publicatie van het rapport voldoet de Raad aan zijn wettelijke verplichting. De Raad attendeert erop dat dit slechts een samenvatting is van alle feiten en bevindingen. Het volledig rapport is digitaal beschikbaar op de website. www.raadrechtshandhaving.com.
