Eindrapport Inspectieonderzoek Review aangifteproces in Curaçao

Willemstad, 6 maart 2015 – In het jaarplan van de Raad is bepaald dat in 2013 een (review)onderzoek zal worden gedaan naar het aangifteproces in Curaçao. De Raad heeft met de inspectie onderzocht in hoeverre en op welke wijze invulling is gegeven door het Openbaar Ministerie en het Korps Politie Curaçao aan de aanbevelingen die de Raad heeft gegeven naar aanleiding van de inspectie van het aangifteproces in Curaçao van mei 2012.

In het rapport review aangifte worden de bevindingen gepresenteerd omtrent de wijze waarop invulling is gegeven door het Openbaar Ministerie (OM) en het Korps Politie Curaçao (KPC) aan de aanbevelingen die de Raad heeft gegeven naar aanleiding van de inspectie van het aangifteproces in Curaçao van mei 2012. Hierna volgt een korte beschrijving van de bevindingen en conclusies van het rapport.

Uit het onderzoek is gebleken dat van de veertien (14) aanbevelingen aan het KPC slechts drie gedeeltelijk zijn uitgevoerd. Het betreft respectievelijk de aanbevelingen: “Draag wijkteamchefs op erop toe te zien dat de instructie huiselijk geweld en de daarbij behorende criteria worden nageleefd door alle korpsleden”, de aanbeveling “Organiseer tevens een publieke informatiecampagne voor burgers over de zaken die zij bij de Centrale Meldkamer kunnen aanmelden” en de derde aanbeveling “Voer op korte termijn een informatie- en registratieaudit van ActPol uit”. De aanbeveling “Voer op korte termijn een informatie- en registratieaudit uit, met het doel om de redenen van het niet optimaal gebruiken van ActPol bij het KPC alsmede de gebruiksvriendelijkheid van het systeem vast te stellen. Speciale aandacht dient daarbij te worden besteed aan de toezichtsverantwoordelijkheid van het Openbaar Ministerie. Maak het systeem toegankelijk voor het Openbaar Ministerie” is ten dele uitgevoerd. Er werd een informatie- en registratieaudit uitgevoerd. Er werd echter geen uitvoering gegeven aan het onderdeel van de aanbeveling om het systeem toegankelijk te maken voor het Openbaar Ministerie.

De Raad heeft in het bovengenoemde rapport van mei 2012 ten aanzien van het OM twee aanbevelingen geformuleerd. Het OM heeft conform de eerste aanbeveling op korte termijn de richtlijnen in verband met slachtoffers herzien en uitgevaardigd. Het OM was ten tijde van dit onderzoek voornemens op korte termijn uitvoering te geven aan de tweede aanbeveling. De tweede aanbeveling was om structureel overleg met de hulpverlenende organisaties in te voeren en de daarbij gemaakte afspraken via instructies binnen het KPC bekend te maken.

Uit bovengenoemde feiten concludeert de Raad dat het KPC in het tijdsbestek van twee jaar onvoldoende uitvoering heeft gegeven aan de aanbevelingen die de Raad heeft gegeven naar aanleiding van de inspectie van het aangifteproces in Curaçao van mei 2012. De Raad is tevreden met de acties die het OM heeft uitgevoerd teneinde invulling te geven aan de aanbevelingen zoals vermeld in het rapport inspectie van het aangifteproces in Curaçao van mei 2012. De Raad spreekt de hoop uit dat binnen korte termijn ook uitvoering gegeven zal worden aan de tweede aanbeveling.
