Willemstad, 16 maart 2015 – De Raad voor rechtshandhaving (Raad) publiceert eindrapport inspectie onderzoek naar het functioneren van de Justitiële Jeugd Inrichting (voormalig GOG). In het jaarplan van de Raad is bepaald dat in 2014 een onderzoek zal worden gedaan naar het functioneren van de Justitiële Jeugd Inrichting (voormalig GOG) te Curaçao. De Raad heeft een inspectieonderzoek verricht naar de organisatie van de JJIC en de wijze waarop de taken worden uitgevoerd. De Raad concludeert dat ondanks de genoemde beperkingen de JJIC als bevoegde en aangewezen instantie conform de wet uitvoering gaf aan de rechterlijke maatregelen van OTS, PIJ en Jeugddetentie ten aanzien van minderjarigen.
De doelstelling van de JJIC is verankerd in zowel de NBO nota 2009 als in het regeerprogramma Curaçao 2013 – 2016. De doelstelling is echter uitsluitend geformuleerd op de behandeling van jeugdige gedetineerden oftewel de jongeren waaraan jeugddetentie of een PIJ-maatregel wordt opgelegd. Er wordt geen rekening gehouden met jongeren die onder de civielrechtelijke maatregel van ondertoezichtstelling (OTS) vallen.
Voor wat betreft het wettelijk kader voor de werkzaamheden van de JJIC concludeert de Raad dat dit kader grotendeels aanwezig is. De overheid was tevens bezig om diverse ontbrekende regelingen betreffende de taken en verplichtingen verbonden aan de inrichting en uitvoering van werkzaamheden van de Justitiële Jeugdinrichting af te ronden.
De organisatiestructuur van de JJIC was ten tijde van het onderzoek conform de oude organisatie van de GOG. Daarnaast was er een masterplan JJIC dat wel door de Minister van justitie was goedgekeurd, maar nog niet door de Raad van Ministers. Met het vaststellen van het masterplan kan de JJIC gericht invulling geven aan de organisatie en de daarbij behorende gekwalificeerde staf en personeel werven.
De Raad heeft bevonden dat de activiteiten volgens het masterplan JJIC 2014 nog niet geïmplementeerd werden, aangezien die activiteiten pas zouden geschieden na voltooiing van de nog te bouwen gesloten- en halfopen afdeling. De in het jaarplan JJIC 2014 uitgewerkte doelstellingen en de daarbij geformuleerde concrete activiteiten werden uitgevoerd, maar niet op het vereiste professioneel niveau vanwege tekort aan voldoende opgeleid personeel en tekort aan infrastructuur en middelen.
Het oude gebouwencomplex verkeerde ten tijde van het onderzoek in slechte fysieke staat en was toe aan een grondige opknapbeurt. Ten tijde van het onderzoek was de JJIC bezig met de bouwwerkzaamheden zoals beschreven in het masterplan JJIC. Het was evident dat vooral de gesloten afdeling daarbij alle aandacht kreeg, waarbij de verbouwing en inrichting van de bestaande paviljoenen en de overige gebouwen voor de halfopen afdeling niet veel aandacht kregen. De Raad is van mening dat de fysieke inrichting van de JJIC als een geheel dient te worden gezien, waarbij de gesloten afdeling en de halfopen afdeling elkaar complementeren en aanvullen en de jongeren van de gesloten afdeling naar de halfopen afdeling kunnen overgaan in het traject van socialisatie en herintegratie in de samenleving.
De nieuwe gesloten afdeling beschikte over een beperkte opvangcapaciteit en was niet ingericht om de jongeren een volledige interne behandeling te laten ondergaan. Daardoor kon aan de jongeren geen volwaardig pakket van interventies worden aangeboden. Aan de jongeren in de halfopen afdeling kon vanwege de verouderde infrastructuur van het complex en het tekort aan personeel een beperkt aanbod van de interventies worden aangeboden. De Raad komt tot de conclusie dat de geconstateerde tekortkomingen met betrekking tot activiteiten, behandelingen en interventies een ernstige bedreiging vormen voor de continuïteit van de activiteiten van de JJIC en de daaraan verbonden nazorg.
Voor wat betreft de scholing concludeert de Raad dat de JJIC, ondanks de beperkte mogelijkheden, in samenwerking met de DOS en het Rooms-Katholieke schoolbestuur conform planning onderwijs aan de jongeren bood. De Raad acht het van essentieel belang dat mede in het kader van de internationale rechten van het kind op korte termijn de nodige aandacht wordt besteed aan de mogelijkheden voor voorbereidend onderwijs voor de jongeren opgenomen in de gesloten afdeling.
De Raad spreekt zijn waardering uit voor de grote mate van betrokkenheid en inzet van de JJIC hulpverleners. De Raad komt tot de conclusie dat door de JJIC conform planning invulling wordt gegeven aan het beschreven traject van advisering ten behoeve de kinderzittingen en het traject van evaluatie-overleg met de jeugdofficier. Tijdens de inspectie is ook komen vas te staan dat de werkzaamheden van de medewerkers van de JJIC tevens werden bemoeilijkt door het ontbreken van structurele bijscholing- en opleidingsmogelijkheden. De Raad concludeert dat ondanks de genoemde beperkingen de JJIC als bevoegde en aangewezen instantie conform de wet uitvoering gaf aan de rechterlijke maatregelen van OTS, PIJ en Jeugddetentie ten aanzien van minderjarigen.
Slot
Het eindrapport is inmiddels aan de Minister van Justitie aangeboden. In artikel 31 van de Rijkswet is bepaald dat de Raad zijn rapport zes weken nadat het aan de minister is aangeboden, openbaar kan maken. Deze termijn is verstreken en bijgevolg is het rapport overeenkomstig de vigerende regeling gepubliceerd. Met de publicatie van het rapport aangifteproces voldoet de Raad aan zijn wettelijke verplichting.
