Eindrapport Inspectieonderzoek Aangifte Raad voor de rechtshandhaving

Willemstad, 1 oktober 2012 – De Raad voor de rechtshandhaving (de Raad) is een rechtspersoonlijkheid bezittend inter-landelijk orgaan van Curaçao, Sint Maarten en Nederland (voor zover het betreft de BES-eilanden). De Raad is ingesteld bij Rijkswet van 7 juli 2010: de Rijkswet Raad voor de rechtshandhaving. De Raad bestaat uit drie leden en wordt ondersteund door een secretariaat. In 2011 heeft de Raad een begin gemaakt met zijn werkzaamheden.

In oktober 2011 werd een inspectieonderzoek gestart naar de wijze waarop het aangifteproces is vormgegeven in zijn onderdelen bestaan, opzet en werking. Het betrof het eerste inspectierapport van de Raad. Het onderzoek werd gehouden in alle deelnemende landen, derhalve in Sint Maarten, Curaçao, Bonaire, Sint Eustatius en Saba. De keuze voor dit thema werd ingegeven door het besef dat de aangifte beeldbepalend is voor de burger in zijn verhouding tot de justitiële keten. Voor de Raad markeerde de inspectie aangifte de eerste stap in een reeks van justitiële activiteiten die in de loop van de komende tijd aan bod zullen komen in de inspecties.

De inspectie inzake het aangifteproces is reeds afgerond. In juni van dit jaar heeft de Raad voor de rechtshandhaving het inspectierapport aangeboden aan de minister van Justitie. Het rapport bevat aanbevelingen ter verbetering van het aangifteproces.

In artikel 31 van de Rijkswet is bepaald dat de Raad zijn rapport zes weken nadat het aan de minister is aangeboden, openbaar kan maken. Deze termijn van zes weken is inmiddels verstreken. Met de publicatie van het rapport aangifteproces voldoet de Raad aan haar wettelijke verplichting.
