Eindrapport inspectie behandeling van personen met verslavingsproblematiek en psychische stoornis in de strafrechtsketen

WILLEMSTAD – De Raad voor de Rechtshandhaving (Raad) concludeert in een inspectierapport over Brasami dat de instelling een bijzondere rol vervult in de zorgverlening en reclassering van personen met verslavingsproblemen en psychische stoornissen binnen de strafrechtsketen. De Raad is van oordeel dat Brasami zich inspant om kwalitatieve zorg aan te bieden en de goede wil heeft om de organisatie te versterken.
Er is een vastgelegde structuur met processen en procedures in de behandeling van cliënten met verslavingsproblemen en psychiatrische stoornissen bestaande uit een detoxificatiefase, een rehabilitatiefase en een resocialisatiefase. Brasami heeft ervaren begeleiders, maatschappelijk werker, sociaalwerkers en medisch personeel in dienst die zich over de zorg ontfermen. Daarnaast wordt Brasami ondersteund door externe professionals zoals psychologen, een psychiater, een arts, de Reclassering, docenten en gedragstherapeuten. Er zijn echter verbeterpunten in de organisatie geidentificeerd. Het rapport van dit onderzoek is inmiddels gereed en aangeboden aan de Minister van Justitie. In de Rijkswet is bepaald dat de Raad zijn rapport zes weken nadat het aan de minister is aangeboden, openbaar kan maken.

De Raad verrichtte dit onderzoek omdat de reclassering van deze personen op een verantwoorde wijze moet worden uitgevoerd en de bejegening respectvol moet zijn. Hiertoe moet een degelijke organisatie en bedrijfsvoering bestaan. Een geslaagde reclassering van veroordeelden die een verslavingsprobleem hebben of psychische stoornis vertonen reduceert de kans op recidive en verhoogt uiteindelijk de veiligheid van de gemeenschap.

Belangrijke vacante functies en inactiviteit organen
Volgens de statuten van de ‘Stichting Opvangtehuis Brasami` bestaat de organisatie uit een bestuur en een Raad van Toezicht. Naast deze organen hebben de Minister van Gezondheid Milieu en Natuur en de Minister van Justitie statutaire bevoegdheden. Verder wordt in de statuten gesteld dat er een directeur is die het personeel benoemt en ontslaat. Uit het onderzoek blijkt echter dat de Raad van toezicht niet actief is, dat het ministerie van justitie onvoldoende betrokken is bij de activiteiten van Brasami en dat de functie van directeur en Manager Zorg al geruime tijd vacant zijn. Er is ook gebrek aan personeel. Het aantal vereiste begeleiders die direct bij de zorg betrokken zijn is niet voldoende. Het personeel van Brasami heeft ervaring in de zorgsector en het merendeel van het personeel heeft de relevante opleidingen genoten.

Financiën, middelen en huisvesting
Er is gebrek aan financiële en materiële middelen. De laatste jaren is op de begroting van de organisatie gekort. Subsidie wordt alleen door het ministerie van Gezondheid, Milieu en Natuur verleend. Het ministerie van Justitie draagt hier niet aan bij terwijl een groot deel van de subsidie aan reparatie van vernielingen, gepleegd door de jeugdige cliënten die onder de verantwoordelijkheid van Justitie vallen, wordt aangewend. Er is behoefte om een ‘cliëntenvolgsysteem’ te introduceren dat kan worden ingezet om informatie met andere partners te delen. De financiële middelen zijn hiertoe echter niet toereikend. Daarnaast is er behoefte aan meer beveiligingscamera’s en personele beveiliging. Het gebouw is verouderd en wordt onvoldoende onderhouden.

De rechtspositie van de cliënten
De rechtspositie van de cliënten is niet vastgelegd. Er zijn geen brochures waarop mededeling wordt gedaan betreffende de rechten en plichten van de cliënten en die informatie verschaft over de behandeling. Er is ook geen formele klachtenprocedure. De meeste cliënten vinden dat de omgangsvormen (bejegening) door het personeel voldoende is.
