Aanpak mensenhandel en mensensmokkel Sint Maarten moet beter
(Philipsburg, Sint Maarten) –

De internationale, interregionale en lokale aanpak van
mensenhandel en mensensmokkel moet beter. Dat stelt de Raad voor de Rechtshandhaving
(hierna: de Raad) in het vandaag, 13 maart, gepubliceerde inspectierapport. De
internationale en interregionale samenwerking is ´ad hoc´ en sterk afhankelijk van
individuele contacten en inspanningen. Ook stagneert de ontwikkeling van een aantal
cruciale onderdelen voor een effectieve integrale aanpak in Sint Maarten al jaren. Dit maakt
de (continuïteit van) de aanpak van mensenhandel en mensensmokkel kwetsbaar.
De Raad constateert dat er in Sint Maarten onvoldoende zicht is op de aard en omvang van
mensenhandel en mensensmokkel. Het bestuurlijk- en strafrechtelijk domein versterken
elkaar niet of nauwelijks. Hierdoor worden in onvoldoende mate barrières opgeworpen
waarmee de gelegenheid tot het plegen van mensenhandel en mensensmokkel wordt
beperkt.
Vooral op het gebied van preventie en bescherming schiet de aanpak van Sint Maarten
tekort. Er is onvoldoende bewustwording van de ernst van de problematiek en het ontbreekt
mede daardoor aan de nodige hulpverlening en bescherming voor slachtoffers. Dit zijn
volgens de Raad cruciale elementen die gerealiseerd moeten worden om te komen tot een
effectieve voorkoming en bestrijding van mensenhandel en mensensmokkel.
Op het gebied van strafrechtelijke handhaving en samenwerking constateert de Raad in Sint
Maarten een aantal positieve ontwikkelingen. Onder andere door de nieuwe focus op de
versterking van het grenstoezicht weten organisaties elkaar steeds beter te vinden. De Raad
moedigt de organisaties binnen en buiten de justitieketen aan de (nu nog op onderdelen
prille) samenwerking in het kader van mensenhandel en mensensmokkel voort te zetten. De
bestuursrechtelijke aanpak kan daarbij niet achterblijven. Om succesvol barrières op te
werpen, zijn bestuurlijke maatregelen en controles onmisbaar. De nodige wetgeving moet
daarvoor op orde gebracht worden en ministeries zullen gezamenlijk
beleidsverantwoordelijkheid moeten nemen voor het voorkomen en bestrijden van alle
verschijningsvormen van deze ernstige misdrijven. Met een strafrechtelijk aanpak alleen kan
het gewenste resultaat niet worden bereikt, aldus de Raad.
De Raad is daarnaast van oordeel dat grote stappen gemaakt kunnen door de internationale
en interregionale samenwerking te verstevigen. Op basis van internationale verplichtingen
om deze ernstige misdrijven te voorkomen en bestrijden, zijn binnen het Koninkrijk
verschillende afspraken gemaakt. De landen binnen het Koninkrijk zijn in een Memorandum
of Understanding overeengekomen om de samenwerking en informatie-uitwisseling te
intensiveren. De landen kunnen volgens de Raad onderling veel meer en effectiever gebruik
maken van elkaars kennis, ervaring, reeds ontwikkelde plannen en voorlichtingsmateriaal.

Om de aanpak van mensenhandel en mensensmokkel te verstevigen doet de Raad negen
aanbevelingen aan de minister van Justitie van Sint Maarten. De aanbevelingen zijn onder
meer gericht op het verbeteren van de informatiepositie en samenwerking, het vergroten van
de bestuurlijke betrokkenheid en het bevorderen van de uniformiteit en continuïteit in de
operationele samenwerking.
In 2016 deed de Raad zes aanbevelingen aan de minister van Justitie ter verbetering van
het prostitutiebeleid in Sint Maarten. Dit rapport van 2016 houdt verband met onderhavig
onderzoek, aangezien de aanbevelingen mede gericht zijn op het voorkomen van
mensenhandel in de prostitutie. De Raad heeft daarom gelijk een review uitgevoerd om te
bezien in hoeverre deze, ruim drie jaar later, zijn opgevolgd. De Raad constateert dat deze
zes aanbevelingen niet zijn opgevolgd. De Raad roept de minister van Justitie op alsnog
gevolg te geven aan de in 2016 gedane aanbevelingen en daarbij de relevante bevindingen
ten aanzien van mensenhandel uit dit inspectieonderzoek mee te nemen.
