Eindrapport Raad voor de Rechtshandhaving betreffende de preventie van jeugdcriminaliteit in Curaçao

Willemstad, 5 december 2016. De Raad voor de Rechtshandhaving (Raad) onderzoek heeft onderzoek verricht naar de preventie van Jeugdcriminaliteit. De Raad concludeert dat bij het merendeel van de organisaties er geen verplichting bestaat tot het geven van nazorg aan de jongeren. Nadat het hulp- en zorgtraject door de organisaties is afgerond wordt de focus in de praktijk gericht op nieuwe of urgentere gevallen. Op grond van het onderzoek komt de Raad verder tot diverse conclusies en doet aanbevelingen op het gebied van o.a. bejegening van jongeren, systematiek om risicojongeren te signaleren en overdracht van behandeling van jongeren. Het rapport van dit onderzoek is inmiddels gereed en aangeboden aan de Minister van Justitie. In de Rijkswet is bepaald dat de Raad zijn rapport zes weken nadat het aan de minister is aangeboden, openbaar kan maken. Deze termijn is verstreken en bijgevolg is het rapport overeenkomstig de vigerende regeling gepubliceerd. In het rapport worden de bevindingen van de Raad gepresenteerd.

De Raad stelt vast dat de preventie van jeugdcriminaliteit niet uitsluitend de taak is van slechts enkele organisaties of instanties. Het is een visie en inspanning die maatschappelijk breed moet worden gedragen voor het bereiken van het uiteindelijk doel. En dat doel is minder first offenders, minder jeugdige delinquenten en minder recidive onder de jongeren.

Het wettelijk kader voor de preventie van jeugdcriminaliteit wordt voornamelijk door het Openbare Ministerie en de Stichting Ambulante Justitiele Jeugdzorg Curaçao gebruikt voor uitvoeringvan preventieve werkzaamheden. Voor de overige betrokken organisaties ontbreekt een wettelijk kader waarin de taken en/of de werkzaamheden betreffende de preventie van jeugdcriminaliteit zijn verankerd.

Uit het onderzoek is komen vast te staan dat voordat de jongeren met de strafrechtketen in aanraking komen, zij meestal door ouders of familieleden aan een of meerdere organisaties zijn aangemeld en is hun vaak reeds individuele hulp en/of zorg aangeboden. De Raad is van mening dat regelmatig schoolverzuim een (eerste) indicatie is dat er sprake is van potentiele risicojongeren. De scholen bieden als eerste schakel in de lijn hulp aan de jongeren en de gevallen die de scholen zelf niet kunnen afhandelen, worden de jongeren aangemeld en/of doorverwezen naar andere instanties die wel passende hulp kunnen aanbieden.

Uit het onderzoek is ook geblekendat het overgrote deel van de jongeren worden aangemeld bij instanties. Deze bieden vervolgens hulp en zorg aan de jongeren. Nadat de jongeren bij de diverse instanties zijn aangemeld worden verschillende acties ondernomen. Een actie die alle instanties ondernemen is het onderling uitwisselen van informatie. Daarnaast vinden er gesprekken met de jongeren plaats zoals het intakegesprek of een aanmeldingsgesprek. De organisaties bieden de jongeren vervolgens een onderbouwd hulpverleningsaanbod aan in de vorm van een plan van aanpak.

Andere aandachtspunten in het rapport zijn de samenwerking in het algemeen en in het bijzonder binnen het project “Tur Wowo Riba Bo”; toetsing van de begeleidingsplannen aan onafhankelijke normen zoals het inbouwen van contactmomenten, kwaliteitscontrole en evaluatiemomenten; regels en procedures voor bejegening van jongeren vastgelegd en de strafrechtelijke route die de jongere moet volgen.

Met de publicatie van het rapport voldoet de Raad aan zijn wettelijke verplichting. De Raad attendeert erop dat dit slechts een samenvatting is van alle feiten en bevindingen. Het volledig rapport is digitaal beschikbaar op de website www.raadrechtshandhaving.com.
