Aanpak mensenhandel en mensensmokkel

WILLEMSTAD – De Raad voor de Rechtshandhaving heeft in 2019 een onderzoek gedaan naar mensenhandel en mensensmokkel om na te gaan in hoeverre binnen het Koninkrijk vorm hieraan is gegeven en in hoeverre deze bijdraagt aan de voorkoming en bestrijding.
Uit het onderzoek van de Raad blijkt dat om mensenhandel effectief te kunnen bestrijden voorzieningen ten aanzien van de “Prosecution, Protection, Prevention en Partnership (de z.g. 4 P’s) getroffen moeten worden. Voorzieningen inzake Prosecution houdt in dat handelingen die tot uitbuiting leiden, in de nationale wetgeving moeten zijn opgenomen. In het kader van Prevention moet onderzoek worden gedaan ter verzameling van informatie, voorlichtingscampagnes worden gehouden, programma’s worden georganiseerd, een beleid worden opgesteld en controles worden uitgevoerd. Voor wat betreft Protection, namelijk de bescherming aan (mogelijke) slachtoffers van mensenhandel, is het noodzakelijk dat de functionarissen kennis en expertise hebben, medische zorg en opvang wordt geboden en tijdelijke verblijfsvergunningen worden verstrekt. Ten aanzien van Partnership is bepaald dat de bureaus voor Slachtofferhulp, de coördinatoren en de experts in de landen bijeen moeten komen om overleg te plegen. De mogelijkheden om informatie uit te wisselen moeten worden onderzocht, twinningspartners moeten worden benoemd en contactenlijsten worden opgesteld. Ook moet met niet-gouvernementele organisaties samen worden gewerkt.

Het Koninkrijk is aangesloten aan een aantal verdragen omtrent mensenhandel en mensensmokkel. Alhoewel niet voor alle verdragen voor Curaçao gelden, zijn er op basis van deze verdragen door Nederland, Aruba, Curaçao en Sint Maarten Memoranda of Understanding opgesteld waarin afspraken zijn gemaakt over de aanpak mensenhandel en mensensmokkel.

In Curaçao is mensenhandel strafbaar gesteld in de titel ´Misdrijven tegen de persoonlijke vrijheid´ en mensensmokkel in de titel ´Misdrijven tegen het openbaar gezag´ van het Wetboek van Strafrecht voor Curaçao. Er is een ´Richtlijn strafvordering mensensmokkel en mensenhandel´ vastgesteld door het Openbaar Ministerie. De Toelatingsorganisatie heeft een beleidsstuk opgesteld inzake het verlenen van vergunning tot tijdelijk verblijf aan slachtoffers, getuigen en aangevers van mensenhandel en mensensmokkel. Verder heeft de overheid een afsprakenlijst om opvangkosten van slachtoffers te dekken opgesteld en een samenwerkingsprotocol met het bedrijfsleven getekend.

Er is een Officier van Justitie (verder OvJ) als diepte specialist belast met de portefeuille mensenhandel en een andere OvJ belast met de portefeuille mensensmokkel. Het Korps Politie Curaçao heeft een speciaal team dat belast is met onderzoeken van mensenhandel en mensensmokkel en er zijn verschillende structuren die informatie verzamelen, veredelen en verstrekken. Het Openbaar ministerie en het Korps Politie Curaçao zijn voornemens om jaarlijks een aantal onderzoeken en controles van mensenhandel en mensensmokkel te verrichten.

Bij het ministerie van justitie is er een coördinator benoemd. De voornaamste taak van de coördinator is het samenbrengen van alle stakeholders. De coördinatoren van de landen van het Caribisch deel van het Koninkrijk houden contact via videoconference.

Er is een Stichting Slachtofferhulp Curaçao die slachtoffers van mensenhandel en mensensmokkel opvangt. Deze stichting werkt samen met 22 niet- gouvernementele organisaties. Om de veiligheid van slachtoffers van mensenhandel te waarborgen is het mogelijk om deze slachtoffers in een van de landen binnen het Caribisch deel van het Koninkrijk op te vangen.

Om de grenscontrole aan te scherpen hebben, onder meer, de grensbewakers van het Korps Politie Curaçao, training gevolgd in signalering van mogelijke gevallen van mensensmokkel. Ook zijn er vertegenwoordigers van verschillende uitvoeringsorganisaties die een cursus over, onder meer, signalering van mogelijke gevallen van mensenhandel hebben gevolgd. Om de signalering te verbeteren is Curaçao voornemens een themaregister te introduceren. Voorts is er een nieuw Protocol ondertekend om de Koninklijke Marechaussee bij de grenscontrole in te zetten.

In het kader van preventie zijn de campagnes “Trago no, smak amargo” en “Un sueño traicionero” gevoerd. Tevens is op het internet (Facebook) informatie geplaatst. Ter voorkoming van mensenhandel is een samenwerkingsprotocol getekend met het bedrijfsleven in Curaçao.

Het voornaamste knelpunt in de aanpak van mensenhandel en mensensmokkel is het gebrek aan voldoende budget. De Raad constateert dat er geen specifiek opvangcentrum is voor slachtoffers van mensenhandel. De bureaus Slachtofferhulp van Curaçao en Caribisch Nederland plegen geen overleg en de experts van de landen komen niet bij elkaar. De mogelijkheid om informatie tussen de landen te delen is ondanks de in de Memoranda of Understanding gemaakte afspraken niet onderzocht. Er wordt weinig informatie en ervaring gedeeld tussen de landen ondanks het feit dat voor dit doel twinningspartners zijn aangewezen en een contactenlijst is opgesteld. Het voornemen van het Openbaar Ministerie en het Korps Politie Curaçao om een aantal onderzoeken en controles per jaar te verrichten lukt niet altijd wegens het gebrek aan personele capaciteit bij het korps.

De Raad concludeert dat de betrokken instellingen zich inspannen om de aanpak van mensenhandel conform de vastgestelde normen uit te voeren, maar is van oordeel dat de aanpak van mensenhandel en mensensmokkel op enige punten voor verbetering vatbaar is.
