(Philipsburg, Sint Maarten) – De Raad voor de rechtshandhaving (“de Raad”) heeft een inspectie naar het gebruik van het Criminaliteitsbestrijdingsfonds van Sint Maarten uitgevoerd. De Raad heeft geconstateerd dat de aandacht en aanbevelingen van de Raad en andere instanties helaas nog niet tot substantiële en structurele verbeteringen hebben geleid. Gelden zijn besteed aan zaken die niet behoren tot de oorspronkelijke doelen van het fonds.

De Raad heeft in dit onderzoek met name bekeken of gelden uit het fonds sinds haar oprichting in 2010 werden toegekend aan projecten waarvoor het fonds is bedoeld. De conclusie van de Raad is dat zelfs bij een ruime uitleg van de begrippen ‘project’ en ‘criminaliteitsbestrijding’ nauwelijks sprake is geweest van bestedingen zoals de wetgever en parlement, destijds beoogde met het fonds.

Doorontwikkeling

Volgens de Raad, zijn kansen om door middel van projecten de doorontwikkeling van de criminaliteitsbestrijding gestalte te geven grotendeels onbenut gebleven. Dit terwijl het criminaliteitsbestrijdingsfonds, dat mede werd opgezet om deze doorontwikkeling te faciliteren, ook werd gebruikt voor zaken waarvoor het niet is bedoeld. Hoewel de uitgaven weliswaar kunnen worden gezien als gerelateerd aan criminaliteitsbestrijding, is het fonds de facto verworden tot een ‘noodvoorziening’ voor de minister van Justitie, van waaruit zaken betaald worden waarvoor binnen de reguliere budgetten van het ministerie en de diensten geen middelen zijn.

Financiering van projecten

Het doel van het criminaliteitsbestrijdingsfonds is de financiering van projecten ten behoeve van criminaliteitsbestrijding. De inkomsten van het criminaliteitsbestrijdingsfonds bestaan onder meer uit betaalde boetegelden, de opbrengsten van ‘asset sharing’ en geldbedragen ter ontneming van het door middel van een strafbaar feit behaald voordeel (de zogenaamde Pluk-ze wetgeving). De minister van Justitie beheert het fonds. Onder zijn toezicht berust de dagelijkse leiding bij het hoofd van de afdeling Justitiële Zaken. Zowel de Raad voor de rechtshandhaving als andere instanties besteedden de afgelopen jaren aandacht aan (onderwerpen gerelateerd aan) het criminaliteitsbestrijdingsfonds en deden aanbevelingen ten behoeve van verbeteringen ten aanzien van het fonds. In zijn laatste gepubliceerde inspectierapport focust de Raad zich op financiering van projecten door het fonds.

Zes aanbevelingen

De Raad benadrukt dat het fonds een waardevolle betekenis kan hebben voor de ontwikkeling van de rechtshandhaving. Goed toezicht op, beheer van, en (democratische) controle op het fonds zijn daarvoor wel voorwaarden. Op grond van zijn bevindingen heeft de Raad zes aanbevelingen gedaan die het beheer van het fonds en daarmee het faciliteren van projecten ten behoeve van de bestrijding van criminaliteit ten goede komen:

  1. Voer de uit de Landsverordening Criminaliteitsbestrijdingsfonds voortvloeiende wettelijke verplichtingen consequent uit. Geef daarbij in ieder geval opvolging aan de reeds door de Raad gedane aanbevelingen ten behoeve van het fonds. Dit betreft: “Voeg bij indiening van de jaarlijkse begroting een beleidsplan waarin projecten zijn vermeld die in aanmerking komen voor financiering uit het criminaliteitsbestrijdingsfonds” en “Leid het daartoe, dat een stuurgroep misdaadbestrijding wordt opgericht en betrek deze bij het beheer van het criminaliteitsbestrijdingsfonds”.
  2. Stel actueel beleid op ten behoeve van het criminaliteitsbestrijdingsfonds. Betrek daarbij criteria, processen en procedures met betrekking tot de aanvraag, de behandeling, de toekenning en (de motivering van) beslissingen ten aanzien van projecten en indien relevant benodigde definities.
  3. Leg ter beperking van risico’s ten aanzien van oneigenlijk gebruik en misbruik van gelden uit het fonds regels en waarborgen vast in een Landsverordening.
  4. Zorg dat de fysieke en digitale administratie/registratie ten aanzien van indienen, beoordelen, toekennen en betaling van projecten volledig is en zorg dat de bijbehorende procedures en bescheiden voortvloeiende uit de geldende wetgeving en beleid worden nageleefd en tijdig worden verkregen.
  5. Draag zorg dat alle vorderingen ten behoeve van het criminaliteitsbestrijdingsfonds worden (terug)betaald.
  6. Geef meer bekendheid aan het criminaliteitsbestrijdingsfonds.
