WILLEMSTAD – De unit Arrestatieteam (AT) van het Korps Politie Curaçao (KPC) is voldoende in staat om haar acties voor het aanhouden van vuurwapengevaarlijke verdachten doeltreffend uit te voeren. Wanneer het AT optreedt, wordt de veiligheid van de teamleden, de verdachten en de algemene bevolking voldoende gewaarborgd. Tot deze conclusie komt de Raad voor de Rechtshandhaving na inspectie van de mate waarin het AT is toegerust op haar taakuitoefening. Daarbij keek de Raad naar hoe het AT is georganiseerd, in hoeverre het over de benodigde middelen beschikt en of de unit in lijn met vastgelegde processen en procedures handelt.
De AT-leden, op drie leidinggevenden na, zijn niet permanent ingezet bij het AT. De andere leden worden opgeroepen en melden zich tijdig om de acties uit te voeren. Het AT bestond ten tijde van het onderzoek uit 13 Fte en was hierdoor onderbemand maar een aantal cursisten waren bezig met de afronding van de AT-opleiding om het AT te versterken. De Raad adviseert de minister van Justitie om zorg te dragen voor structureel tijdige opleidingen om de gewenste bezetting zeker te stellen. Ook ziet de Raad op middellange termijn graag specialistische opleidingen voor additionele vaardigheden.

Sneller geld
De financiële procedure moet worden versoepeld om onnodige vertragingen en oponthoud te voorkomen in, bijvoorbeeld, de aanschaf van geschikte voertuigen. Het AT beschikt weliswaar over de voorgeschreven basisbewapening, aanvullende bewapening en ook andere soorten materiële middelen, maar een aantal middelen moet worden geactualiseerd.

Vastlegging
Een verzoek om het AT in te zetten moet schriftelijk worden gedaan door het onderzoeksteam. Verder moet zowel intern –bij de korpsleiding – als extern – bij de zaaksofficier van Justitie – een toestemming worden gevraagd. De Raad constateerde dat door werkdruk de interne toestemming niet wordt vastgelegd. Het advies hierover aan het KPC is dan ook om zorg te dragen om alle acties van de inzet van het AT te registreren en om op korte termijn regels ten aanzien van de interne toestemmingsprocedure vast te leggen. Maar ook de verlening van de externe toestemming door het Openbaar Ministerie wordt niet vastgelegd.

Wanneer aan de geldende criteria in het beleid van het OM en het inrichtingsplan van het KPC wordt voldaan en er tot de inzet van het AT wordt overgegaan, worden de deelprocessen voor de voorbereiding, de uitvoering en de monitoring naar behoren doorlopen. Het AT wordt vooral ingezet bij het aanhouden van vuurwapengevaarlijke verdachten, het verrichten van ondersteunende- en beveiligingstaken en het transport van verdachten. Tijdens de periode die werd geïnspecteerd, is het AT volgens een overgelegd overzicht niet ingezet in verband met terrorisme of het boarden van vaartuigen terwijl volgens beleid dit wel mogelijk is.

Maskers en blinddoeken
Bij de uitvoering van aanhoudingen dragen de AT-leden maskers en worden de verdachten geblinddoekt. De European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) bekritiseert deze handelingen. Volgens de procedures van het AT is deze werkwijze echter noodzakelijk in verband met de veiligheid van alle betrokkenen.
